Terms of Service

These terms are an agreement between you and Everive ("Everive", "we", "us"). They apply to everive.com, our quiz, the waitlist, free trials and, once released, our app. By using any of them you agree to these terms. If you don't agree, please don't use them.

1. Our app

These terms cover the Everive app and services that link to them. The app may have extra terms shown in the app or at checkout. Those extra terms win if they differ from these.

2. Before launch

• Joining a waitlist is free and doesn't commit you to anything.
• If you reserve a free trial with a card, you will not be charged before the app launches. Pre-launch trials are set to cancel automatically at the end of the trial. When the app launches, we'll ask you before any paid subscription starts.
• If you're ever charged by mistake, we refund it in full. See our Refunds & trials policy.

3. Eligibility and accounts

You must be at least 18 and able to enter a binding contract. Give us accurate information, and keep your email and payment details up to date.

4. Subscriptions, trials and payments

• Payments and trials are processed by Whop, which acts as our payment provider. Whop's own terms also apply to the checkout.
• Once the app is released, a subscription renews automatically at the price and interval shown at checkout until you cancel.
• A free trial turns into a paid subscription only if the app is released and the trial wasn't cancelled, as explained at checkout.
• You can cancel any time from the link in your Whop receipt or by emailing hello@everive.com. Cancellation stops future renewals.
• Prices may include or exclude taxes depending on where you live, as shown at checkout.

5. Health and wellbeing content

The quiz, plans and app content are for general information and self-improvement. They are not medical advice, diagnosis or treatment. Talk to a qualified professional before changing your diet, exercise, sleep or medication. See our Disclaimer.

6. Acceptable use

Don't misuse the site or app. In particular, don't:

• break the law, or infringe anyone's rights;
• try to access systems or data you're not allowed to, or disrupt the service;
• scrape, copy, resell or redistribute our content or app without permission;
• submit false information, or use someone else's payment details.

7. Intellectual property

We (or our licensors) own the site, quiz, app, names and logos. We give you a personal, non-transferable licence to use them for their intended purpose while these terms apply.

8. Disclaimers and liability

The site and app are provided "as is". To the extent the law allows, we don't guarantee that they will always be available or error-free, and our total liability to you is limited to the amount you paid us in the 12 months before the claim (or USD 50 if you paid nothing). Nothing in these terms limits liability that can't be limited by law, or your rights as a consumer.

9. Ending these terms

You can stop using the site at any time. We may suspend or end access if you break these terms. Sections that by their nature should survive (such as liability and intellectual property) continue to apply.

10. Changes

We may update these terms. The date at the top shows the latest version. For important changes we'll give notice by email or on the site; continuing to use the service means you accept the new terms.

11. Law and disputes

These terms are governed by the laws of the United States, without overriding the mandatory consumer protections of the country you live in. Please contact us first so we can try to resolve any problem quickly.
